BAOA Appealed  Against Increase In Parking Charges


An appeal filed by the Business Aircraft Operator’s Association (BAOA) challenging the increase of fifty times in parking charges as approved by Airport Economic Regulatory Authority for General Aviation Aircrafts by its order was challenged before the Hon’ble Airport Economic Regulatory Authority Appellate Tribunal (AERAAT). A not for profit organization, BAOA, is a unified voice of the Business Aviation sector in the country.

BAOA’s main grievance was increase in parking charges up to 50 times was allowed by AERA retrospectively with effect from  after having rejected the same. The increase despite being unreasonable and untenable has been allowed without conducting any study and citing any reasons. BAOA further averred that AERA could not have allowed such an increase, which is completely contrary to the pricing principles for parking charges as set out in OMDA and SSA.

Mr. Ramji Srinivisan, Senior Advocate as instructed by Clasis Law pressed for immediate urgent reliefs. Senior Counsel opposed the BAOA’s appeal on behalf of MIAL and sought time to file its reply. After hearing BAOA’s appeal, the AERAAT was pleased to issue notice in the matter and directed MIAL to furnish an undertaking within a week’s time that it will deposit the amount collected through increased parking charges for overstay of General Aviation Aircraft in an interest bearing account to be maintained separately.

In case, BAOA finally succeeds in its appeal, then BAOA members would be entitled to be reimbursement along with 10% from MIAL.
President of BAOA said that we have full faith in the AERAAT and expressed that,This has become a matter of survival for the industry. If such unreasonable charges are allowed half of the existing members and non scheduled operators would have to pack their bags and look for alternative business opportunities elsewhere.
